Terms of Service
The terms governing MossImage accounts, credits, subscriptions, acceptable use, generated images, and commercial use.
Last updated: 2026-10-20
1. Agreement
These Terms of Service ("Terms") form an agreement between you ("you") and MossImage ("MossImage", "we", "us") for the use of getmossimage.com and the hosted image generation service (the "Service"). By creating an account, buying credits, or using the Service, you agree to these Terms and to our Privacy Policy.
If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you confirm that you have authority to bind that organization, and "you" includes it.
2. The Service and the MOSS-Image model
MossImage is an independent hosted service built on the open-source MOSS-Image model released by the OpenMOSS Team under the Apache License 2.0. MossImage is not affiliated with, endorsed by, or sponsored by the OpenMOSS Team. Model names and licenses belong to their respective owners.
The Service runs the SFT variant of MOSS-Image for hosted generation. We may change model versions, providers, safety systems, or generation parameters to improve quality, safety, or reliability. We do not promise that a particular model version, seed, or output will remain available.
3. Eligibility and accounts
- You must be at least 13 years old to use the Service. If you buy credits or a subscription, you must be at least 18 years old or the age of majority in your jurisdiction.
- Provide accurate account information and keep your credentials secure. You are responsible for activity under your account.
- Do not create multiple accounts to circumvent free limits, rate limits, suspensions, or credit rules.
- Tell us promptly at support@getmossimage.com if you suspect unauthorized access.
4. Free credits, credits, and generation costs
- New accounts do not receive signup credits. Instead, signed-in accounts receive 2 free credits per UTC day when they load the site. A Draft costs 1 credit, so this is two Draft renders. Unused daily credits expire at the end of the day, and the grant is subject to fair-use and abuse limits.
- Paid renders use credits. Current prices are shown on the pricing page and in the generator. At the time of publication: Draft costs 1 credit, Final costs 3 credits, HD costs 7 credits, and Max costs 12 credits.
- Credits are deducted when a task is submitted. If a task fails for a reason within our control, the deducted credits are returned to your balance.
- Credits are a prepaid usage balance. They are not money, do not earn interest, and cannot be transferred, sold, or redeemed for cash except where law requires.
- Any credit expiration date is shown at purchase or in your credit history. We may change credit prices and generation costs with notice on the pricing page.
5. Subscriptions, renewal, and cancellation
- Paid subscriptions are sold through Waffo and renew automatically at the interval shown at checkout until canceled.
- You can cancel from the billing page or by contacting support. Cancellation stops future renewals; it does not retroactively refund the current period. Access and recurring credits continue until the end of the paid period unless the Terms or the plan state otherwise.
- If a renewal fails, we may retry it or suspend the subscription. You remain responsible for charges already incurred.
- We may change subscription prices with advance notice. The new price applies to the next renewal after the notice period.
- Waffo and its payment partners may apply their own terms, authentication, and currency-conversion rules.
6. Refunds
- Credits that have been consumed are not refundable.
- Unused credits and subscription fees are refundable only where required by applicable law or where we choose to grant a refund because of a billing error, a duplicate charge, or a sustained service failure.
- To request a refund, contact support@getmossimage.com with the order identifier and the reason. We may ask for information needed to verify the charge.
- Do not file a chargeback before contacting us. If you do, we may suspend the account while the dispute is investigated.
- Nothing in this section limits mandatory consumer rights in your jurisdiction.
7. Acceptable use
You must follow applicable law and the following rules. You may not use the Service to create, upload, store, request, or distribute:
- Sexual content involving minors. Zero tolerance. Any child sexual abuse material or sexualized depiction of a minor will be reported to the relevant authorities and the account will be permanently terminated.
- Non-consensual intimate content or sexual deepfakes. Do not depict a real person in a sexual, intimate, or humiliating context without documented consent.
- Pornography or sexually explicit content outside any permitted use.
- Extreme violence, gore, animal cruelty, or content that encourages suicide, self-harm, terrorism, or violent extremism.
- Hate speech, harassment, threats, or discriminatory content targeting a person or protected group.
- Fraud, impersonation, or deceptive deepfakes, including fake endorsements, fake documents, fake currency, and disinformation campaigns.
- Intellectual property infringement, including counterfeiting logos, copying protected characters, or reproducing a living artist's style in a way that violates their rights.
- Privacy violations, including publishing someone's personal data, private images, or identifying information without permission.
- Malware, phishing, scams, or illegal goods and services.
- Attempts to bypass safety filters, rate limits, credit accounting, or access controls, including prompt injection, automated account creation, scraping private endpoints, or reverse engineering the Service.
We may remove content, refuse a generation, rate-limit an account, or suspend access when we reasonably believe these rules are broken. We may preserve and report evidence when the law requires it.
8. Your prompts and content
You keep ownership of the prompts, reference images, and other material you submit ("User Content"). You grant us a limited, worldwide license to host, copy, process, transmit, and display User Content only as needed to operate the Service, provide support, investigate abuse, and comply with law.
You represent that you have the rights needed to submit User Content and to request the output you ask for. Do not submit confidential information, trade secrets, or personal data you are not allowed to share.
We do not use private prompts or generated images to train a public model. We may use aggregated, de-identified statistics to operate and improve the Service.
9. Generated images and commercial use
- As between you and MossImage, and subject to these Terms and applicable law, you own the images generated for your account.
- You may use your generated images for personal and commercial purposes, including client work, advertising, and products, if you have the necessary rights in the prompt, reference material, and depicted subject matter.
- Copyright protection for AI-generated material varies by jurisdiction. We do not guarantee that an output is copyrightable or that it does not resemble existing protected work.
- Do not present a watermarked render as an unwatermarked deliverable, and do not remove or obscure a watermark in order to misrepresent the tier of an image.
- If an output depicts a real person, brand, character, or logo, you are responsible for clearing those rights before commercial use.
10. Watermark and free tier
Images generated by accounts that have not paid include a MossImage watermark. A completed one-time credit-pack purchase removes it permanently; an active subscription removes it while the subscription is active (including a scheduled cancel that has not reached the end of the paid period). Credits from admin gifts or the free daily grant do not remove the watermark. The model provider's safety systems and any legal notices may still apply.
11. AI output disclaimer
Generative AI is probabilistic. Output may be inaccurate, biased, offensive, or unexpected, and rendered text may contain spelling or layout errors. You must review every image before publishing it, especially for prices, dates, names, medical or legal claims, and regulated products. The Service is not a source of professional advice.
12. Content moderation
We may use automated filters before and after generation, and may review reported content manually. Filters can produce false positives and false negatives. A successful generation is not an endorsement, and a blocked generation is not a determination that your intended use is lawful.
13. Intellectual property of the Service
The MossImage name, logo, website design, interface, documentation, and proprietary code are owned by us or our licensors and are protected by intellectual property law. These Terms do not grant you a license to use our brand except to refer accurately to the Service.
The MOSS-Image model and the official workflow files are distributed under the Apache License 2.0 by the OpenMOSS Team. That license governs those files, not the MossImage hosted Service or brand.
14. Third-party services
The Service relies on third parties, including fal.ai for inference, Waffo for payments, and Cloudflare for hosting. Their outages, policies, and fees can affect the Service. Your use of a third-party service may be subject to its own terms. We are not responsible for third-party services we do not control.
15. Availability and changes
The Service is provided on an evolving basis. We may add, change, suspend, or discontinue features, models, quality tiers, or plans. We aim to give reasonable notice of material changes that affect paid credits, but we do not guarantee uninterrupted or error-free operation. Maintenance, provider outages, and abuse prevention may interrupt generation.
16. Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms, create risk for other users or third parties, or if required by law. On termination, your right to use the Service ends. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, and indemnity — continue to apply.
If we terminate your account for a breach, unused credits may be forfeited to the extent permitted by law. If we discontinue the Service for our convenience, we will handle unused paid credits in good faith, subject to applicable law.
17. Disclaimers
To the maximum extent permitted by law, the Service and all outputs are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. We do not warrant that an output will be unique, error-free, or free of third-party claims.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
18. Limitation of liability
To the maximum extent permitted by law, MossImage and its operators, employees, and suppliers are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity, arising from or related to the Service, even if advised of the possibility.
Our total liability for all claims relating to the Service in any 12-month period is limited to the greater of the amount you paid us for the Service in that period or USD 100. This cap does not apply where the law prohibits it, including liability for fraud, willful misconduct, or death or personal injury caused by negligence.
19. Indemnity
You will defend and indemnify MossImage and its operators against claims, damages, losses, and reasonable legal fees arising from your User Content, your generated images, your commercial use of an output, or your breach of these Terms, to the extent permitted by law.
20. Governing law and disputes
These Terms are governed by the laws applicable where the MossImage operator is established, without regard to conflict-of-law rules. Courts at that location have exclusive jurisdiction, except where mandatory consumer law gives you the right to bring a claim elsewhere.
Before filing a claim, contact support@getmossimage.com and allow a reasonable opportunity to resolve the dispute informally.
21. Changes to these Terms
We may update these Terms to reflect product, legal, or operational changes. We will change the "Last updated" date and, for material changes, provide notice in the product or by email where appropriate. If you continue to use the Service after the effective date, you accept the updated Terms.
